Terms of Service

By using RESF.AI (“the Service”) you agree to these Terms. If you don’t agree, don’t use the Service. The Service is operated by Jorge Guerra Jr.

The Service helps real-estate agents keep a personal sphere of clients, contacts, and outreach reminders. Features include categorizing contacts, tracking daily goals, drafting outreach messages using AI, and syncing a private working calendar. RESF.AI is a productivity tool — it is not a brokerage, licensed advisor, or custodian of client funds.

You retain all rights to contact data and notes you add. You grant RESF.AI a limited license to store, process, and display that content solely to operate the Service for you. We don’t access, publish, or share your content except as described in the Privacy Policy.

The Service uses a third-party AI (Anthropic’s Claude) to suggest outreach messages. Drafts are starting points — you are responsible for reviewing and editing them before sending, and for the accuracy, tone, and legal compliance of anything you ultimately send to a client. RESF.AI makes no warranty that AI-drafted text will be accurate or appropriate for your jurisdiction.

You agree not to:

• Import or store data about people who have asked you not to contact them.
• Send spam, harassment, or content that violates applicable law (CAN-SPAM, TCPA, GDPR, CCPA, or local equivalents).
• Attempt to reverse engineer, scrape, or disrupt the Service.
• Use the Service to violate the privacy of anyone listed in your contacts.
• Impersonate another person or misrepresent your affiliation with a brokerage.

The Service integrates with Google (OAuth, Contacts, Calendar, Gmail), Anthropic (Claude), Turso (database hosting), and Vercel (application hosting). Your use of those integrations is also governed by those providers’ terms. We’re not responsible for their outages, bugs, or policy changes.

While in early access, the Service is provided at no charge. We may introduce paid tiers with reasonable notice. You’ll have the option to accept new pricing, export your data, or delete your account before any charge is incurred.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be preserved without loss.

To the maximum extent permitted by law, RESF.AI and its operator will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising from your use of the Service. Our aggregate liability for any claim relating to the Service is limited to USD 100.

You agree to indemnify and hold RESF.AI harmless from any claims arising out of your misuse of the Service or violation of these Terms, including claims by people whose data you’ve added without authorization.

We may suspend or terminate your account at any time if you violate these Terms. You may terminate by emailing j@resf.com. On termination, your data is deleted within 30 days unless legal obligations require retention.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts sitting in Miami-Dade County, Florida, and you consent to that venue.

We may update these Terms. Material changes will be posted here and highlighted on the home page for at least 14 days before taking effect. Continued use after the effective date means you accept the update.
